The Georgia E-Verify law requires that private employers with 10 or more employees use the federal E-Verify system for new hires. SB 160 mandates the use of E-Verify not only for public contractors (including subcontractors and sub-subcontractors) providing labor to public projects, but also those providing services of any kind (except for attorneys).
E-Verify is an Internet based system operated by the Department of Homeland Security (DHS) in partnership with the Social Security Administration (SSA) that allows participating employers to electronically verify the employment eligibility of their newly hired employees.
Private employees with fewer than 10 employees are required to provide evidence claiming to be exempt from the requirement to register and utilize the E-Verify program and such evidence must be presented in the form of an affidavit. Dade County cannot grant a business license without a notarized E-Verify Affidavit. Registration information is available on the E-Verify website.
The State of Georgia has made participation in the SAVE Program mandatory for any agency administering a business license. SAVE, short for the Systematic Alien Verification for Entitlements, is a federal, Internet-based program which is operated by the U.S. Citizenship and Immigration Services. The SAVE affidavit verifies each applicant's lawful presence in the U.S. by allowing the applicant to affirm either that they are a "U.S. Citizen or legal permanent resident 18 years of age or older" or that they are "a qualified alien or non immigrant lawfully present in the U.S. and providing the applicant's alien number."
Business / Occupation Tax Certificate
As required by Official Code of Georgia § 50-36-1(1) any applicant for a Dade County Business/Occupation Tax Certificate must execute an affidavit certifying legal presence in the United States and attach a front and back copy of one secure and verifiable document for identification.
